How much is the Maine R&D tax credit?

Maine Revenue Services

5% / 7.5% incremental (ME)

The short version

Maine's credit is 5% of your Maine research spending above your 3-year average, plus 7.5% of basic research payments. $500,000 of extra spending earns $25,000. Unused credit carries forward 15 years.

Maine's Research Expense Tax Credit (36 M.R.S. §5219-K) provides a 5% credit on incremental qualified research expenses above a three-year average base, plus a 7.5% credit on basic research payments to qualifying institutions. The credit applies to Maine-located research only, is non-refundable, and carries forward up to 15 years. A unique annual cap structure limits a corporation's credit use each year to 100% of the first $25,000 of tax owed plus 75% of tax exceeding $25,000 — meaning companies with substantial tax liability cannot apply the full credit in a single year, but the 15-year carryforward allows eventual full utilization.

Who qualifies

Common questions about the Maine credit

Who can claim it?

Any business that pays Maine income tax and spends money on qualifying research done in Maine. The credit is taken against the tax due under Maine's income tax law. "Qualified research expenses" means the same thing as in the federal research credit, Section 41 of the tax code, but only research conducted in Maine counts. Maine's tax assessor may combine the research of related companies under common control, so a group is measured as one.

How is the base worked out?

The base is your average yearly spending on qualified research over the previous 3 tax years. Only the part of this year's Maine research spending above that average earns 5%. If you spent $700,000 this year and averaged $200,000 before, the excess is $500,000 and the credit is $25,000. Basic research payments to qualifying organizations earn 7.5% of the payment, with no base to clear.

How much can I use in one year?

The statute caps each year's use for a corporation at 100% of its first $25,000 of Maine tax plus 75% of the tax above that. The credit can never take your tax below zero, and nothing is refunded. What you cannot use carries forward for up to 15 later tax years, so a young company with little tax now can still use it as profits grow.

Is it better than the federal R&D credit?

They are different credits with different rates, not alternatives. Federal law gives 20% of spending above a base amount, or 14% under the simplified method, against federal tax. Maine's 5% is lower but runs against Maine tax, and it follows the federal definitions of qualifying research. See the federal Section 41 credit for the federal side.

What if I owe no Maine tax yet?

You can still build the credit and carry it forward, but it only pays off once you have Maine tax to offset. If you need cash sooner, a grant fits better: see the Maine Technology Institute seed grant or Maine small business grants.

How to apply

  1. 1

Establish the three-year average base period

Calculate the average Maine-located qualified research expenses for the three preceding tax years. This base period average is the threshold above which the 5% incremental credit applies. Controlled groups must aggregate all members' Maine QREs.

    ~3 hrs

  2. 2

Identify and document qualified research expenses

Apply the federal §41 four-part test to all R&D activities conducted in Maine. Qualifying expenses include: wages for employees whose time is devoted to qualifying research (or a portion thereof), supplies consumed in conducting research, and 65% of amounts paid to non-employees for qualifying research conducted in Maine. Exclude: research conducted outside Maine, social science research, funded research (under contract or grant), and routine quality control.

    ~6 hrs

  3. 3

Identify basic research payments (if applicable)

Identify any payments made to qualifying institutions — universities, scientific research organizations, and other §41(e)(1)(A) qualifying entities — for basic research conducted in Maine. These payments earn the higher 7.5% credit on the full payment amount (not incremental). Obtain documentation from the receiving institution confirming the payment and qualifying research purpose.

    ~2 hrs

  4. 4

Calculate the credit and annual cap

Compute: 5% × (current year Maine QREs − three-year average base) + 7.5% × qualifying basic research payments. Then apply the annual usage cap: 100% of the first $25,000 of Maine income tax liability + 75% of tax liability above $25,000. Any excess credit is carried forward up to 15 years.

    ~2 hrs

  5. 5

Claim on Maine income tax return

Report the credit on Maine Schedule A (individuals, Form 1040ME) or the applicable business credit schedule for corporate filers. Track the carryforward balance and prior-year credits applied to ensure accurate cumulative reporting. Retain all QRE documentation — time records, expense receipts, project descriptions, employee allocation schedules — for at least 3 years post-filing.

Insider tip

Maine's 15-year carryforward is one of the longest in the US — ideal for early-stage companies with minimal tax now but growing liability ahead. The annual cap (100% of the first $25,000 of tax plus 75% of the rest, for a corporation) spreads use over time, and the carryforward keeps unused credit from being lost.

Deadline & timing

Credit claimed on annual Maine income tax return. Calendar-year individual filers due April 15; calendar-year corporate filers due April 15. Fiscal-year filers use the 15th day of the 4th month following fiscal year-end. Maine Revenue Services may request supporting documentation; contemporaneous records should be retained for at least 3 years post-filing. Maine does not require pre-approval for the credit, but MRS may audit QRE calculations.
